How To Spot A Mortgage Scam

How to Spot a Mortgage Scam

While the landmark $25 billion National Mortgage Settlement was just announced last month, scammers have wasted no time capitalizing on the vulnerability of desperate homeowners.

The settlement with the nation’s five largest mortgage servicers was signed by federal and state officials Feb. 9, and will provide assistance for homeowners in order to compensate for the faulty foreclosure practices offered by mortgage servicers following the housing market crash. According to the nonprofit credit-counseling agency Money Management International (MMI), although real compensation is still months away, there have already been numerous reports of scam operations popping up across the country.

“While the government has been cracking down on foreclosure scams, it is important for you to remain diligent in keeping your personal information safe,” advises Jo Kerstetter, vice president of education and community relations for MMI.

Kerstetter offers the following tips to help avoid a scam:

Don’t panic. Mortgage scams are effective because the scammer is able to exploit the fear of a person who is in a desperate, vulnerable state. Don’t let fear cause you to make irrational decisions.
Never act under pressure. Don’t sign a contract or disclose information before doing your research. You can always request to receive any information in writing.
Trust your gut. If someone is offering you something that sounds too good to be true, it probably is.
Stay informed. Make sure you obtain detailed information about your foreclosure deadlines. If you want to know if you qualify under the Settlement, contact your bank or loan servicer directly.
Don’t release any personal financial information. If you are contacted by someone who claims to be from your financial institution and wants you to “confirm” or help them identify your personal account information, it is likely a scam. Rather than releasing information, ask for their contact information and tell them you’re going to call them back.
There is no fee involved in the National Mortgage Settlement. If you are contacted in any way from someone asking for money in return for a speedy settlement payment, they are scamming you.
For more information about mortgage assistance relief scams, visit FTC.gov. If you have questions or concerns about your mortgage loan, consider meeting with a HUD-certified housing counselor to discuss your options.

Defense.gov News Article: Family Matters Blog: Show Seeks Families for Home Makeover

Defense.gov News Article: Family Matters Blog: Show Seeks Families for Home Makeover

From the American Forces Press Service:

WASHINGTON, April 19, 2011 – I’m excited to share new information about an amazing opportunity for deserving military families.

The producers of ABC’s “Extreme Makeover: Home Edition” are seeking people involved in the military whose home deserves an extreme makeover.

The producers are looking for people with “amazing strength of character and who put their own needs aside to help others,” a press release said. “Whether it’s a soldier, a mom, a teacher or a fireman, we think deserving families are families who inspire those around them.”

Additionally, the show’s producers are seeking families whose houses need major alterations or repair – “homes that present serious problems for the family and affect the family’s quality of life.”

To be eligible, families must own their single family home and be able to demonstrate how a makeover will make a difference in their lives.

Interested military families or people who wish to nominate a military family should e-mail a short description of the family’s story to emheusa@gmail.com. The e-mail should include the names and ages of household members, a description of the family’s challenges, an explanation of why the family is deserving of a makeover or is a positive role model in the community, photos of the family and their home, and contact numbers.

The deadline for nominations is May 30, but people should send submissions early, the release said. Only up to 25 families are selected each season.

For more information on the application process, visit
http://abc.go.com/primetime/xtremehome/index?pn=apply.

Please pass this information on to deserving military families. I hope to see a few on “Home Edition” next season.

We continue to monitor the events unfolding in Japan since March 11, 2011, when a 9.0-magnitude earthquake struck off the shore of northeast Japan, triggering a tsunami.

5963 La Place Court, Suite 312

AVOID ROUTE 50/FAIRFAX PARKWAY INTERCHANGE WEEKEND OF JAN. 8-9

From the VA Dept of Transportation:

AVOID ROUTE 50/FAIRFAX PARKWAY INTERCHANGE WEEKEND OF JAN. 8-9
Plan now to use alternate routes to avoid delays

FAIRFAX – The Virginia Department of Transportation is urging motorists to avoid the Route 50 and Fairfax County Parkway (Route 7100) interchange area on Saturday and Sunday, Jan. 8-9, as lane closures for construction-related pile driving will cause major delays.  The lanes closures are in effect from 11 p.m. Friday night until 11 p.m. Sunday night.
Weather permitting, the following lane and ramp closures are planned:

On westbound Route 50, three lanes will narrow to one lane from West Ox Road to just west of the parkway.  Lanes will shift to the right through the work zone under the Fairfax County Parkway bridge.

On eastbound Route 50, three lanes will narrow to two lanes and traffic will shift to the right approximately 300 feet prior to the Fairfax County Parkway.  All three lanes will be open east of the bridge.

Two ramps will be closed: Northbound Parkway to westbound Route 50 and southbound Parkway to eastbound Route 50. Traffic headed north on the Parkway will turn left on Rugby Road to Route 50. Traffic headed south on the Parkway will be detoured left on Fair Lakes Parkway, and left on West Ox Road to Route 50.

On the Fairfax County Parkway over Route 50, one of two lanes in each direction will be closed.
Avoid eastbound Route 50:Shoppers heading to Fair Oaks Mall should use I-66 rather than Route 50 and Stringfellow Road rather than the Fairfax County Parkway.
Take Route 50 East to Route 28 South to I-66 East or to Route 29 North.
Take Route 50 East, turn right on Stringfellow Road, left on Route 29 North.

Avoid westbound Route 50:Leaving Fair Oaks Mall, take Fair Lakes Parkway, turn right on Stringfellow Road, left on Route 50
From I-66, continue west past Route 50 and exit at Route 28 North
Coming from the City of Fairfax, use Route 29 as an alternate route.
The lane closures are part of the Fairfax County Parkway and Fair Lakes Interchange construction project which began in late October.  VDOT’s contractor will be driving piles to add a pier to widen the Parkway bridge to three lanes over Route 50. The actual pile driving will be done between 7 a.m. and 9 p.m. both days.

VDOT typically allows its contractors to close lanes only at night or on weekdays between rush hours.  However, this work requires at least 10 hours of uninterrupted construction which would not be possible on a weekday without affecting rush hour traffic.  The work cannot be done at night because Fairfax County’s noise ordinance prohibits pile driving at night. VDOT postponed the work until after the Christmas holidays to minimize impacts to shoppers.

Fairfax County police will be staged in the work zones for safety and traffic management.
More information on the construction project is available here. Motorists can sign up for traffic alerts at http://www.511virginia.org/.

Mortgage Interest Deduction - is it still Vunerable?

Possibly. Even though the report from the Commission for Deficit Reduction will not go to Congress for an automatic vote, there is the possibility that individual pieces of it -- such as curbing the mortgage interest deduction -- could be included in the proposed budget that will be sent to Congress in January.

Healthcare Law and Real Estate Tax

After the new health care bill passed earlier this year, there have been many emails making the rounds talking about the 3.8% tax that will be imposed on the sale of real estate starting January 2013, the purpose of which is to help pay for the cost of implementing the new law.  There are bits of truth and rumor in many of these emails.  It is true that the 3.8% tax exists ... it is not true that this tax will affect all, or even most, real estate transactions.  However, if you make an AGI of over $200,000, there is a possibility that it may affect you.  The National Association of Realtors has put together an excellent brochure to help clarify the ramifications of this new law and to give examples of the impact of this tax.  As always, you should consult with your tax advisor for advice regarding your individual situation.
